Prize Draw Terms and Conditions
Participants
1. Subject to the following sentence, the “Tell us what you think of Shell V-Power competition/prize draw (the “Competition”) is open to persons who are 18 years or over and who are a resident of the United Kingdom. The Competition is not open to (i) employees (and their immediate families (spouse, parent, child or sibling)) of Dennis Publishing (publishers of Auto Express) or the Promoter or their affiliates, subsidiaries, agencies, advisors; and (ii) anyone else involved in the creation or administration of the Competition. Internet access required.
Competition Mechanics – General
2. The Competition will run from Friday 18 December 2009 to 23.59 on Friday 26 February 2010 inclusive.
3. Entry is online only via the dedicated competition site at www.writeintogear.co.uk
4. The Competition will be split into 2 stages as detailed in these terms and conditions. The 100 (one hundred) entrants who have written the best written statements in stage 1 of the Competition (as determined by the Judges) will progress through to the prize draw stage of the Competition.
How to enter Stage 1 of the Competition
5. In order to be in with a chance of being entered into the prize draw, entrants are required to provide a written statement in English in no more than 75 words describing what they think about Shell V-Power and the difference it makes to their car; and (ii) to complete a registration form providing full contact details. Entry is online only via the site at www.writeintogear.co.uk.
6. Entries must be received no later than 23.59 on Friday 26 February 2010.
7. Only one entry per person.
8. Articles should consist of original content and reflect the content guidelines below. Entries may not be libelous, offensive, blasphemous or obscene. Shell, in its absolute discretion, reserves the right to refuse entries if they fall under one of these categories.
9. Submissions should be in an accessible style that engages an audience that does not understand or has not thought about the benefits of using premium fuels before.
10. Articles can be serious or humorous in their approach.
Judging and voting
11. Shell will appoint 4 (four) judges (the “Judges”) for the Competition. The following is a list (in no particular order) of the judging criteria that will be applied by the Judges:
• Relevance to topic
• Accuracy of spelling, punctuation and grammar
• Adherence to length restrictions
• Linguistic flair
• Ability to communicate information in a way that is articulate, memorable, fun, entertaining and motivating
• Clarity of expression
• Ease of understanding
• Creativity but without compromising accuracy
• Technical integrity
• Objectiveness
• Evidence of passion for car/fuel performance and technology
12. The 100 best written statements in stage 1 of the Competition will be determined by the Judges. The Judges’ decision on its selection of the 100 best written statements in stage 1 of the Competition is final.
13. The judging panel will feature two Shell representatives, one Auto Express representative and a judge who is independent of both Shell and Auto Express.
The Prize Draw
14. The 100 (one hundred) entrants who have written the best written statements in stage 1 of the Competition (as determined by the Judges) will be automatically entered in the prize draw.
15. The prize draw will be conducted by Shell and the 10 (ten) winners of the prize draw will be randomly selected by end of February 2010.
16. The winners of the prize draw will be contacted by Shell in the week commencing 01 March 2010 by telephone and/or in writing using the contact details provided by him/her on the competition registration form.
Prizes
17. There are 10 (ten) prizes of a piece of Ferrari merchandise (including but not limited to umbrellas, t-shirts, scarves, hats, and bags) to be won in the prize draw. The prizes will be sent via courier to the address included on the winners’ registration forms.
Copyright
18. By entering the Competition and submitting a written statement the entrant hereby assigns to the Promoter with full title guarantee all intellectual property rights in the written statement submitted as part of the promotion. The entrant hereby irrevocably waives all moral rights or other transferable rights in the written statement to which the entrant is or may at any time in the future be entitled or any similar provisions of law in any jurisdiction.
19. By entering the Competition, the entrant hereby confirms that he/she has not incorporated any third party material in the written statement, including but not limited to images, artwork, logos, extracts and quotations, save where the entrant has obtained, at no cost to the Promoter, prior to such inclusion a licence for the Promoter to use the third party material on the terms set out in paragraph 20 below.
20. The entrant hereby grants to the Promoter an irrevocable, world-wide, royalty free, perpetual licence and right to use and have used, copy, modify and distribute any such third party material which is necessary to use and/or exploit the written statement for any purpose and to grant sub-licences to affiliates of the Promoter and/or third parties.
Promoter rights
21. In the event of unforeseen circumstances the Promoter reserves the right to offer alternative prizes of equal or greater value.
22. To the extent only permitted by applicable law, the Promoter reserves the right to use the winners’ voice, image, photograph, name and likeness for publicity and in advertising, marketing or promotional material without additional compensation or prior notice to the winner and in entering the Competition, all entrants consent to the same.
23. No cash alternative will be offered and the prize is non-transferable. By accepting the prize, a winner agrees to hold the Promoter and its affiliates harmless against any and all claims and liability arising out of the award of, the use or misuse of any prize. Where the law implies warranties, which cannot be excluded, the Promoter’s liability for breach of those warranties is limited to resupplying the prize (or paying for the costs thereof), where this is permitted by law. A winner assumes all liability for any injury or damage caused, or claimed to be caused by participation in this promotion or use or redemption of any prize.
24. If proven to be technically incorrect or in the event of breach of security and also fraud, the Promoter reserves the right to cancel or suspend the promotion.
25. Proof of emailing will not be accepted as proof of delivery and no responsibility can be accepted for entries lost, delayed, mislaid or for any technical failure or for any event which may cause the Competition to be disrupted or corrupted.
26. The Promoter’s decision is final in every situation including any not covered above and no correspondence will be entered into.
General
27. By entering the Competition participants will be deemed to have accepted and be bound by the terms and conditions which will be interpreted in accordance with English law and subject to the exclusive jurisdiction of the English courts.
28. The names and counties of the winners will be made available on request to those enclosing a stamped self-addressed envelope to Brand & Communications, Shell Oil Products, Rourke House, Staines TW18 3BA within 6 weeks of the prize draw.
29. By entering the Competition entrants agree that their personal data submitted as part of the Competition entry process will be stored and processed on behalf of Shell as data controller in accordance with applicable data protection laws. Entrants agree that such data may be used to contact the winners of the prize draw and for publicity purposes as stated above and winners’ names and counties will be provided on request. A request to access, update or correct any information should be directed to Shell at the address set out below.
